Kaan Finch Group were the architects for an off the plan property we purchased. We signed the contract in November 2007. In June 2009 we were informed that the local council had approved changes to the building plan. In our unit there was a floor space reduction of @10%. The way the law is in NSW we were unable to argue for compensation for this reduction from the developers. This firm is involved in significant changes in building plans after they have been released for sale. This is obviously legal. That does not make it right.
It all depends if the changes were done by the developers or dictated form council. I assume you have agreed on a design and with a contract, it this ultimately there should be a clause about variation of design etc.
Sorry to hear that, as Architect and home buyer I understand your frustration, seeking expert legal advice I think is priceless sometimes.. Cheers Andrea Costi
